Terms of Service

1. Eligibility

You must be at least 14 years old to use the Service. By using it, you confirm that you meet this requirement and that the information you provide is accurate. If you are under the age of majority in your country, you must have permission from a parent or legal guardian.

2. Your account

• You are responsible for keeping your login credentials confidential and for all activity under your account.
• You agree to provide accurate, current, and complete information and to keep it up to date.
• You may create only one personal account, and you may not share it with others.
• Notify us promptly of any unauthorised use of your account or any other breach of security.

3. Licence to use the Service

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial purposes, subject to these Terms. We retain all rights not expressly granted.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in breach of any applicable law or regulation;
• Reverse engineer, decompile, or attempt to gain unauthorised access to the Service or its infrastructure;
• Access the Service by any automated means (bots, scrapers, crawlers, data mining, or scripts), or overload, disrupt, or interfere with the Service or its servers;
• Upload content that is illegal, infringing, or that violates the rights of others;
• Misuse location or navigation features in a way that endangers yourself or others;
• Resell, sublicense, or commercially exploit the Service without our written permission.

5. Your content

You retain ownership of the routes, GPX files, activities, and other content you create or upload ("Your Content"). You grant us a limited licence to host, store, process, and display Your Content as necessary to operate the Service (for example, to render your routes, generate previews, and sync with connected devices).

If you choose to share a route or make content public (e.g. via a share link), you grant us and recipients the right to access and display that content for that purpose. You are responsible for ensuring you have the right to upload and share Your Content.

The licence for content that you keep private ends when you delete that content or your account. However, if you have shared content publicly or via a link, copies that others have already accessed or saved may remain outside our control, and we may continue to make a shared route available to recipients of its link until you unshare or delete it.

6. Connected services and third-party data

The Service integrates with third-party providers (e.g. Wahoo, Hammerhead, Google sign-in) and uses third-party and open data sources for maps and routing (e.g. OpenStreetMap, OpenMapTiles, Overture Maps, Valhalla). Your use of those integrations is also subject to the respective third party's terms. We are not responsible for third-party services, and map and routing data may be incomplete or inaccurate.

7. Safety disclaimer

Use the Service responsibly. Flamap provides maps, routes, and navigation for informational purposes only. Routes, distances, elevation, surface types, and points of interest may be inaccurate, outdated, or unsuitable for your activity. You are solely responsible for your safety. Always obey traffic laws, pay attention to your surroundings, and do not rely solely on the app while moving. Conditions such as road closures, weather, and terrain can change. We are not liable for any accident, injury, or damage resulting from your use of routes or navigation.

Before starting any route or activity, it is your sole responsibility to assess, taking into account your own circumstances, whether:

• you have the physical fitness and ability required for the route;
• your equipment is suitable and in good condition for the route and conditions;
• the weather and environmental conditions are safe and do not pose a risk to life, health, or property;
• the route is open and legal to use — you must observe local rules, signage, closures, and warnings (e.g. due to traffic, works, or hazards such as avalanche or flood risk), which can change at any time.

Not medical advice. Fitness metrics (calories, heart rate, power, etc.) are estimates and are not a medical device or medical advice. Consult a qualified health professional before starting or changing any exercise programme. You participate in physical activity at your own risk.

8. Fees

The Service is currently provided free of charge. We reserve the right to introduce paid features or subscriptions in the future; if we do, we will inform you in advance and you will not be charged without your consent. Any payments would be processed through the Apple App Store or Google Play in accordance with their terms.

9. Intellectual property

The Service, including its software, design, trademarks, and content (excluding Your Content and third-party/open data), is owned by us or our licensors and is protected by intellectual property laws. You may not copy, modify, or distribute it except as permitted by these Terms. Open and third-party data is used under its respective licences and attributions.

10. Privacy

Our processing of your personal data is described in our Privacy Policy, which forms part of these Terms.

11. Suspension and termination

You may stop using the Service and delete your account at any time from within the app. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. On termination, the licences granted to you end; provisions that by their nature should survive (e.g. disclaimers, liability, intellectual property) will remain in effect.

12. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure. Nothing in these Terms limits any rights you have as a consumer that cannot be excluded under applicable law.

13. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of the Service. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded under applicable law (including mandatory Spanish and EU consumer protection rules).

14. Indemnity

You agree to hold us harmless from claims arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or the rights of a third party, to the extent permitted by law.

15. Changes to these Terms

We may update these Terms from time to time. We will post the updated version with a new "Last updated" date. Where changes are material, we will give you reasonable advance notice (for example, within the app or by email) before they take effect. If you do not agree to the updated Terms, you may reject them by stopping use of the Service and deleting your account before they take effect; otherwise, continued use of the Service after that date constitutes acceptance. This does not affect your mandatory rights as a consumer.

16. Governing law and jurisdiction

These Terms are governed by Spanish law. Any dispute will be subject to the competent courts of Spain, without prejudice to any mandatory consumer-protection rights that entitle you to bring proceedings in the courts of your place of residence within the EU.
